1. Acceptance of Terms

By downloading, installing, or using the Healthy Buddy mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Healthy Buddy ("Company," "we," "our," or "us"), registered in Spain.

Age Requirement: You must be at least 16 years old to use this App. By using the App, you confirm that you meet this age requirement.

2. Description of Service

Healthy Buddy is a mobile health and wellness tracking application that provides:

• AI-powered nutrition tracking via photo scanning, voice input, and manual entry
• Wellness diary with mood tracking and AI-generated insights
• Exercise and workout logging with calorie estimation
• Intermittent fasting timer and protocols
• Supplement tracking with reminder notifications
• Body, Mind, and Soul wellness challenges
• Streak-based gamification system

3. Medical Disclaimer

You acknowledge and agree that:

• The App is a tracking tool, not a medical device or healthcare provider
• You should always consult a qualified healthcare professional before starting any diet, exercise program, or making changes to your health routine
• Never disregard professional medical advice or delay seeking it because of information provided by this App
• If you have or suspect you have a medical condition, immediately contact your healthcare provider
• Results may vary; the App is a tracking tool, not a guaranteed solution

4. AI Accuracy Disclaimer

You acknowledge that:

• AI-generated nutritional data (calories, macros, etc.) are estimates only
• Photo recognition may misidentify foods or portion sizes
• Actual nutritional values may differ significantly from estimates
• AI-generated wellness insights are general observations, not professional advice
• The Company makes no warranty regarding the accuracy of AI-generated content

5. Account Registration

To use certain features of the App, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access
• Not share your account with others

We support authentication via email/password, Google Sign-In, and Apple Sign-In through Firebase Authentication.

6. Subscriptions & Payments

6.1 Subscription Plans

Healthy Buddy offers free and premium subscription tiers. Premium features require a paid subscription.

6.2 Billing & Renewal

• Subscriptions are billed through your app store account (Apple App Store or Google Play Store)
• Subscriptions automatically renew unless canceled at least 24 hours before the renewal date
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• Subscription management and cancellation are handled through your app store account settings

6.3 Free Trials

If we offer a free trial, it will convert to a paid subscription unless canceled before the trial ends. You will not receive additional notice before conversion.

6.4 Refunds

Refunds are handled according to the policies of your app store (Apple or Google). We do not directly process refunds. Contact your app store for refund requests.

6.5 Price Changes

We reserve the right to change subscription prices. Existing subscribers will be notified in advance, and price changes will apply after the current billing period ends.

7. User-Generated Content

7.1 Your Content

You retain ownership of content you submit (photos, text entries, etc.). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store your content solely to provide the App's services.

7.2 Content Guidelines

You agree not to submit content that:

• Violates any applicable laws or regulations
• Infringes on intellectual property rights
• Contains malicious code or viruses
• Is fraudulent, false, or misleading

7.3 Content Removal

We reserve the right to remove any content that violates these Terms or that we deem inappropriate, without prior notice.

8. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Reverse engineer, decompile, or disassemble the App
• Transmit viruses, malware, or other harmful code
• Scrape, data mine, or extract data from the App
• Interfere with or disrupt the App's operation
• Impersonate others or provide false information
• Use the App to harass, abuse, or harm others
• Resell, sublicense, or commercially exploit the App
• Use automated systems (bots) to access the App

9. Intellectual Property

9.1 Our Rights

The App, including its design, features, content, trademarks, logos, and code, is owned by Healthy Buddy and protected by copyright, trademark, and other intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

9.3 Restrictions

You may not:

• Copy, modify, or distribute the App
• Use our trademarks without written permission
• Create derivative works based on the App
• Remove any copyright or proprietary notices

10. Limitation of Liability

10.1 Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 Limitation of Damages

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or goodwill
• Health outcomes or dietary results
• Reliance on AI-generated nutritional data
• Interruption of service
• Personal injury or property damage

10.3 Maximum Liability

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 (USD), WHICHEVER IS GREATER.

10.4 Health Outcomes

We make no guarantees regarding weight loss, health improvements, or any other outcomes. Your results depend on many factors beyond our control. The App is a tracking tool, not a treatment or cure.

11. Indemnification

You agree to indemnify, defend, and hold harmless Healthy Buddy, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit through the App

12. Account Termination

12.1 Termination by You

You may delete your account at any time through the App settings or by contacting us. Upon deletion, your data will be removed according to our Privacy Policy.

12.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Abuse the App or other users
• Fail to pay subscription fees (if applicable)

12.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination will remain in effect (including Limitation of Liability, Indemnification, and Dispute Resolution).

13. Dispute Resolution

13.1 Informal Resolution

Before initiating any legal action, you agree to first contact us at team@healthybuddy.app to attempt to resolve the dispute informally. We will work in good faith to resolve concerns within 30 days.

13.2 Binding Arbitration

If we cannot resolve the dispute informally, you agree that any dispute, controversy, or claim arising out of or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the Spanish Arbitration Court (Corte de Arbitraje).

• Arbitration will be conducted in Spain
• The arbitrator's decision will be final and binding
• Judgment may be entered in any court of competent jurisdiction

13.3 Class Action Waiver

Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.

Any legal proceedings not subject to arbitration shall be brought exclusively in the courts located in Spain, and you consent to the personal jurisdiction of such courts.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make material changes:

• We will update the "Last Updated" date at the top
• We will provide at least 30 days' notice before significant changes take effect
• We may notify you via email, in-app notification, or the App website
• Your continued use of the App after changes constitutes acceptance

If you disagree with the updated Terms, you must stop using the App and delete your account.
